1. Acceptance
By accessing or using Capybara Market ("capybara-market.com"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.
2. Eligibility
You must be at least 18 years old and legally capable of entering into binding agreements. By signing up, you represent that all information you provide is accurate.
3. What We Do
Capybara Market is a marketplace connecting sellers and buyers of digital products (SaaS apps, side projects, domains, etc.). We facilitate discovery, AI-powered valuation, bidding, and asset transfer. We are not a party to the transaction between buyers and sellers.
4. Listings & Verification
Sellers may list digital products by providing a URL or GitHub repository. We use AI and third-party APIs to generate estimates and verify ownership. Sellers are responsible for the accuracy of their listings. Capybara Market does not guarantee the accuracy of AI-generated valuations.
5. Bidding & Payments
Bids are binding and irrevocable once placed. Buyers must provide a valid payment method. When a bid is accepted, the buyer's payment method is charged immediately. A 7% platform fee is deducted from the transaction amount.
6. Transfer & Delivery
Upon acceptance, sellers must transfer all listed assets within the specified deadlines (source code within 24 hours, remaining assets within 14 days). Failure to deliver may result in dispute resolution. Buyers must confirm receipt of assets to release funds to the seller.
7. Disputes
Either party may flag a dispute during the transfer process. We will review disputes in good faith but are not obligated to resolve them. In case of unresolved disputes, parties may need to seek external remedies.
8. Prohibited Activities
You may not: list products you do not own or have rights to sell; misrepresent product metrics or capabilities; use the platform for money laundering, fraud, or any illegal purpose; attempt to circumvent the platform to avoid fees.
9. Limitation of Liability
Capybara Market is provided "as is." We are not liable for losses arising from transactions, inaccurate valuations, failed transfers, or service interruptions. Our total liability is limited to the platform fees collected from your transactions.
10. Changes
We may update these terms at any time. Continued use constitutes acceptance of the updated terms.
